Acceptance
By using Equaliser AI you accept these Terms. If you do not accept them, do not use the service. Equaliser AI is a business-to-business service: by subscribing you confirm you are acting in the course of a business, not as a consumer.
The service
Equaliser AI is a paid-media intelligence platform. We provide AI-driven insights, reports, and tooling via equaliser.ai. We do not guarantee specific outcomes: the decisions are yours. The platform is a decision-support tool, not a replacement for professional judgement. AI-generated analyses and recommendations are advisory only. Equaliser connects with read-only scopes and does not execute changes on your ad accounts; if per-action execution ships in the future, every action will require explicit human approval, under scopes you grant at that point and can revoke. You remain responsible for every decision you act on.
Your account
You are responsible for keeping your login credentials secure. Tell us immediately if you suspect unauthorised access. Each person uses their own login; account sharing breaches the Terms.
Your data
You retain ownership of all data you bring to the platform (advertising data, reports, brand assets). We process it only to deliver the service: see the Privacy Policy. Where we process personal data on your behalf, our Data Processing Addendum forms part of these Terms.
Our platform
Equaliser AI and its licensors own all intellectual property in the platform: the software, models of analysis, scoring methods, interfaces, and documentation. Your subscription grants a non-exclusive, non-transferable licence to use the service for your business while it is active; it transfers no ownership. Reports and AI-generated outputs produced from your data are yours to use and share with your clients. We never sell your data or train models on it. Aggregated, de-identified usage patterns may be used to improve service reliability; they are never shared or sold.
Acceptable use
- Do not attempt to reverse-engineer, scrape, or abuse the platform.
- Do not use the service for unlawful activity or content.
- Do not connect data sources you do not have permission to connect.
- Do not share your login. Plans include unlimited team seats; each person uses their own login, and there are no per-seat charges.
Fees & billing
Paid plans bill monthly in GBP, exclusive of VAT, which is added at the prevailing rate. Onboarding carries a one-off setup fee agreed before your subscription starts. Cancel at any time: access continues to the end of the paid period. The monthly subscription may be cancelled within the first 14 days for a full refund of that month’s subscription fee. The setup fee is non-refundable once build work has begun. We reserve the right to change pricing with 30 days’ notice. We may suspend access for non-payment after 14 days’ written notice. Refunds are otherwise issued at our discretion for material service failures, unless the Data Processing Agreement provides a specific remedy.
Uptime & support
We target 99.5% monthly uptime on production, measured over each calendar month; uptime reports are available on request. This is a service target, not a warranty; sustained failure to meet it is handled under Termination and Limitation of liability. Scheduled maintenance is announced 48 hours in advance. Support is by email, with a response within 1 UK business day (Monday to Friday, 09:00 to 17:30 UK time).
Limitation of liability
Equaliser AI is provided “as is”. We are not liable for indirect, incidental, or consequential damages. Our total liability is capped at the fees you have paid in the preceding 12 months. Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud. Questions about this clause, or any liability or claim matter: contact@equaliser.co.uk.
Termination
You can cancel at any time, effective at the end of the current paid period. We can terminate with 30 days’ written notice, or immediately for material breach of these Terms. On termination we will export your data in a portable format within 30 days, then delete it as described in the DPA.
Governing law
These Terms are governed by the laws of England & Wales. Disputes are subject to the exclusive jurisdiction of the English courts. These Terms (with the Privacy Policy and DPA) are the entire agreement between us. No one other than you and Equaliser Ltd may enforce them; the Contracts (Rights of Third Parties) Act 1999 is excluded. If any clause is found unenforceable, the rest stand. Neither party is liable for failure caused by events beyond its reasonable control.
Changes
We will notify registered users of material changes by email 14 days before they take effect.
